Ltd. and all services, information, info-graphics and data content (including but not exclusive to Images and Written Word) presented herein are owned by the us. Website users, including Customers, Vendors, Service Providers, Browsers and Content Suppliers will be hereby referred to as the “User” and the owners of this website; Baking Magic Pvt. Ltd. as the “Company”. Actions to use this website for the purpose of Ordering, Collaborating, Perusing for information of our services or even simply for the purpose of browsing and gathering information will be understood to be with acceptance of the “Terms and Conditions” provided herein. All our services provided, and not included through this channel solely, will be in accordance with these “Terms and Conditions”. Users of any part of this website are therefore advised to acquaint themselves with the same.

General:

1. Prices for our Products and Services are subject to change at our discretion and from time to time. Notice for the same will be provided through any means suitable to the Company and the User is expected to bear the responsibility of keeping themselves aware of any such developments.
2. Information and Images regarding Products and Services provided here are subject to change and their accuracy is notwithstanding any legal guarantee. We however try our best to avoid errors on these grounds and appreciate any feedback about the same.
3. The Company reserves the right to disclose any User’s personal information that is stored in our databases for any legal compliances and whenever necessary to protect our rights. In the case of compliance with a court order, legal process or judicial proceeding served on our site, disclosure of personal information is necessary.
4. The Company strives to maintain data security of its Clients’ Information with the understanding with the User that any inadvertent leak of the same does not make us legally liable. The information is collected solely for the purpose of providing our Users the Products and Services they so desire and provide them a convenient experience while availing them.
5. The Company reserves the right to limit or cancel the sale of any of its Products and Services, provision of Offers, Promotions and Discounts. Any grievances arising thereof will be entertained on a case-to-case basis and exclusively according to the discretion of the Company. Quoting past instances or instances relating to other cases of our customers or cases raised with other similar service providers is unadvisable and not relevant to us.
6. Provision of certain Products and Services, related Offers, Discount and Promotions may be available only for orders through this website, unless specified otherwise by the Company.
7. The Company reserves the right to cancel any order on grounds of misbehaviour and misrepresentation of facts by customers reported by our owners, employees or other customers.
8. Any guarantee for the fitness of Products for safe and optimum consumption are provided by the Company only in the case that all Storage and Consumption Instructions, provided herein (Terms and Conditions: Storage and Consumption) are followed. The same will be verified and ascertained by the Company in case of any Refund or Replacement Claims raised on these grounds.
9. The Company does not promise to provide an Allergen free product unless exclusively requested for and confirmed by us. Products and Services provided here are liable to have experienced Cross-contamination with allergens like dairy, eggs, nuts, soy, flour, sugar, essential oils, pollen and/or other allergy causing ingredients. The User agrees to notify all the people consuming the products about the same. The User agrees to indemnify and to not hold The Company accountable for any allergic reactions in the event of any such claims.
10. No Products, Services or Data/Information (Images and/or Written Word) may be replicated or resold without our express permission for the same. This may be considered to be an exception in the case of our Authorised Resellers or Stockists and Students of our Workshops.

Online Ordering:

1. All orders on the Website will be processed & confirmed only after a 100% advance payment is made, there is no provision for Cash on Delivery.
2. GST & Delivery charges will be calculated after your product is added to the cart.
3. Delivery charges depend upon requested delivery area and a minimum order amount of INR 350 and subject to change depending on Date and Area.
4. There is no provision for Cancellation of Products once ordered through Website Shop, in case of unavailability of Ordered Product for the particular day we will contact you for a an alternative replacement or full refund upon cancellation, the same will be raised by us through any mutually accepted payment method.
5. Quantity of Certain Items are restricted to person ordering Online through or Website Shop. For any requirements exceeding the pre-set “Maximum Order Quantity” Contact us directly.
6. Pick-ups or Delivery of Items ordered outside the time-frame of Shop Operations are scheduled for the following Working Day in the First available Delivery Slot.
7. All items are Hand-made and dependent on the behaviour of its ingredients. They are photographed under artificial or natural light and these pictures viewed over a range of electronic devices. There is a possibility of the finished product with an appearance, for example and not exclusive to its shade of colour or visible textures, varying from its image on this website or any other place of reference used.

Pick-up and Delivery:

1. All our Products are of a delicate nature and unless expressly agreed to must be delivered in the first attempt. Deliveries are not re-attempted in case of unavailability of the Consignee/Customer or their nominated Representatives and in case of inaccurate/inadequate address or contact information provided by the User or Customers the Delivery is considered completed and no claims arising from such cases will be entertained.
2. All deliveries are expected to be completed in a time window of 1 Hour Post and Prior to the requested Time of Delivery, understand that this window is provided in case of unavailability of Delivery Partners and or delays arising due to similar conditions.
3. In the event a Third-Party Delivery Service is being used by customers for our Product, the Company is not liable for any damages or deterioration of the Product due to improper handling or carriage/stowage during the delivery.
4. The Company expressly advises against the use of Porters or Valets for the delivery of Products due to their delicate nature, however on certain occasions even we have to use these services and in cases where we are booking the Porters or Valets, any claims arising from Product damage will be dealt with by the discretion of the Company and exclusively on a case-to-case basis, without upholding any precedents whatsoever.
5. Products are at the risk of the customer once handed over to them or their representatives, the Company limits its liabilities to Products that are being delivered by us or our representatives up to the point of time the Product has been handed over and subject to naturally occurring conditions which we have no control over. Delivery may be cancelled or delayed if in any case the conditions are unsuitable for the successful completion of the same.
6. Ownership of the Product is transferred to the Customer upon completion of 100% of the price and Dispatch for Delivery or Hand-over during Pick-up is only done upon completion of 100% payment.
7. In no case do we collect our payments through Third-Party Delivery Service Representatives or any other person who is not directly employed by us and on a pay-roll, please DO NOT hand over any fraction of the payment for the Product to anybody who has no proof of our employ and unless we have advised you to do the same.

Refunds and Replacement:

1. Refunds or Replacements for Item Damage, Incomplete Order or acceptable Quality Concerns are dealt with on a case-to-case basis and without upholding any precedents whatsoever. Requests can be made through our “Contact Us” page or by calling on +91 9769619932.
2. A request for Refund or Replacement once made will be scrutinized by our team for the validity of its claim before a Refund is issued through a channel mutually agreed upon. In case of Replacement of Product further liaison and co-ordination regarding pick-up and redelivery will be carried out by the Company itself through any mutually acceptable and accessible means.
3. Any request for modification of customized cakes, gifts or bulk orders are subject to approval at the discretion of the Company and only entertained up to 3 days prior to stipulated Delivery/Hand-over.
4. Order Cancellation Requests are not entertained for items other than Customised Cakes, Gifts, Bulk Orders unless made 6 days prior to stipulated Delivery/Hand-over. Please visit our “Contact Us” page to make your request for the same or simply call +91 9769619932.
5. Order Cancellation once approved will still attract a Processing Fee of 20% of the Order Value; Quoted or Billed. Refund of remainder of the Advance payment made will be processed by any mutually agreed upon payment method.
6. No Credit will be issued for amount already paid as an Advance in the event of Cancellation of Order.
